KBRI Failure in The Context of Migrants Citizen Services

Policy failure occurs when the state blames the migrant for being "illegal" rather than acknowledging that the "safe" procedures were never accessible to the NTT poor.

To address the policy delivery failures concerning irregular female migrants from Nusa Tenggara Timur (NTT), we must frame these failures as a disconnection between bureaucratic performance and the lived reality of the migrant.

The following table categorizes these systemic failures, focusing on the gap between the state’s stated policy goals and the actual outcomes for NTT migrants.

The Non-Binding Trap:

 

Consular Services Embassy as an “Information Hub”Propaganda vs. Education:

Branding bureaucratic paperwork as “safe migration” while ignoring the structural precariousness and high costs that drive migrants toward irregularity.

 

Legal Protection Bilateral MoUs as “legal safeguards.”

 

 

MoUs often lack enforcement mechanisms; they function as diplomatic theater rather than enforceable labor law, leaving migrants without recourse when employers violate contracts.

 

The embassy prioritizes image-management (propaganda) over “citizen-centered learning.”

 

Information delivery is one-way, lacking interactive platforms to teach migrants their rights or safety strategies.

 

High-level diplomacy is often disconnected from the daily survival of the diaspora.

 

Current “Chief Diplomat” functions are treated as ceremonial rather than operational duties toward the most vulnerable constituents.

 

 

Analysis of the Gaps

  1. The Myth of “Safe Migration” Procedures

The policy gap here lies in the criminalization of the migrant’s survival strategy. When the state promotes “safe migration” procedures that are prohibitively expensive or bureaucratic, they essentially create a funnel.

Migrants who cannot afford the “safe” route—but have the same economic necessity—are pushed into irregular channels. Policy failure occurs when the state blames the migrant for being “illegal” rather than acknowledging that the “safe” procedures were never accessible to the NTT poor without debt trapping by the licensed agents and non licensing human traffickers.

  1. The MoU as a “Legal Fiction

The use of non-binding bilateral agreements creates a liminal legality protection gap.

These agreements offer the appearance of legality to calm public outcry or international bodies, but they offer no substance to the individual worker.

When the state treats a non-binding MoU as if it were a robust legal framework, it creates a dangerous illusion of security, leading migrants to enter hazardous conditions under a false belief that the state will intervene if things go wrong.

  1. Embassy “Propaganda” vs. “Citizen-Centered” Service

This represents a failure of pedagogical diplomacy. A citizen-centered embassy would operate like a community resource center, focusing on:

Educational Interactive Learning: Teaching migrants how to navigate the local labor market, how to identify abuse, and how to access local legal aid. Instead, embassy outreach often focuses on top-down communication (announcements/warnings) that does not acknowledge the reality of the migrants’ lives. It fails to treat the migrant as a knowledgeable agent who needs tools, not just orders.

Hiding behind the no intervention and noncircumvention rules is not fulfilling citizen protection embassy  roles  In Malaysia.

Structural violence of BPJS scheme do not offer imnediates needs of social protection  to Indonesian migrants. Citizen need protection at host country not after they return. Needs legislative reviews.

  1. The “Chief Diplomat” Deficit

When the leadership of the diplomatic mission fails to prioritize the protection of the most vulnerable (the irregular migrants), it demonstrates a clash of values.

Diplomacy is often prioritized toward state-to-state relations (trade, political stability, tourism) while the “citizen-centered” function—the duty to protect the most precarious citizens—is relegated to a back-office administrative task.

This is the definition of “lip service”: the language of care is used, but the resources and political will are directed elsewhere.

The “failure” of the state is not just a lack of funding; it is a structural choice to prioritize diplomatic optics over the welfare of the migrant. The migrant’s refusal to “regularize” is a rational response to these systemic failures: they know the “legal” system has failed them, so they rely on the community (the NTT network) rather than the state (the Embassy). *****
